Terms of Service

1. Acceptance of Terms
By accessing or using Smash ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is provided by Mulham Analytics and AI - FZCO, a company registered in the International Free Zone Authority (IFZA), Dubai Silicon Oasis, United Arab Emirates.
2. Description of Service
Smash is a club-first padel platform that enables players to create and manage clubs, organize sessions and tournaments, discover venues, and track their performance. The Service is provided via web application and mobile apps.
3. User Accounts
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account.
- You must be at least 13 years old to use the Service.
- One person may not maintain more than one account.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose.
- Harass, stalk, intimidate, or otherwise harm other users — whether in the app, via WhatsApp invites initiated from the app, or through any other medium.
- Send repeated friend requests, session invites, or messages to a person who has rejected a request, ignored it, or blocked you.
- Use a clubmate's phone number (exposed via the WhatsApp-invite feature) for any purpose other than inviting them to the specific session the feature was designed for. Harvesting numbers, adding them to bulk contact lists, or forwarding them to third parties is a material breach of these Terms.
- Attempt to gain unauthorized access to any part of the Service.
- Use automated tools to scrape or interact with the Service without permission.
- Impersonate another person or entity.
- Upload malicious content or interfere with the Service's operation.
5. Friendships, Invites & Safety
5.1 Friend requests
Friend requests require mutual consent. A pending request gives no rights beyond appearing in the recipient's "Incoming requests" list. Rejection is silent — the sender is not notified. Only accepted friends appear in each other's Friends tab.
5.2 WhatsApp invites
The WhatsApp invite feature is opt-in. Your phone number is only exposed to the WhatsApp click-to-chat URL if you have explicitly enabled that setting on your profile. Disabling the setting takes effect immediately for all subsequent session views.
Smash never sends messages on your behalf. The feature opens the inviter's WhatsApp app with a pre-filled message; the inviter must tap Send. Once a message has left the Smash app, its contents are outside our control and governed by WhatsApp's own terms and by your local laws.
If you receive invites from someone you do not wish to hear from, you can: (i) disable the opt-in in your profile to stop all app-mediated invites; (ii) block the specific player to exclude them from your clubmate and friend lists; (iii) report them to safety@playsmash.io.
5.3 Blocking & reporting
You may block any other player at any time. Blocking is silent and mutual in effect: the blocked player cannot send you new friend requests, will not see you in clubmate-filtered pickup-game lists, and will not appear in your own friend or clubmate surfaces.
You may report any player for harassment, spam, impersonation, or other violation of these Terms by emailing safety@playsmash.io. We review reports within 72 hours and may suspend or terminate accounts that violate these Terms, at our sole discretion and without notice when an imminent safety risk is present.
6. Club Management
Club administrators are responsible for the conduct of their club members within the platform. Smash reserves the right to suspend or remove clubs that violate these terms, including clubs whose members repeatedly abuse the invite or friend-request features.
7. Venue & Booking Information
Venue information displayed in Smash is sourced from third-party providers (Google Places, Playtomic) and user contributions. We do not guarantee the accuracy, availability, or pricing of venue information. Court bookings initiated through WhatsApp links are between you and the venue; Smash is not a party to those transactions.
8. Intellectual Property
The Smash name, logo, and all original content, features, and functionality are owned by Smash and are protected by international copyright, trademark, and other intellectual property laws.
9. Subscriptions & Payments
9.1 Pricing
Some features require a paid subscription. The full price, billing frequency, and any free-trial or promotional conditions are shown to you on the upgrade screen before you commit. Prices shown to users in the United Arab Emirates are displayed in UAE Dirhams (AED), inclusive of any applicable VAT. We do not add a surcharge for paying by credit or debit card; the price you see is the price you pay.
9.2 Billing and auto-renewal
Subscriptions renew automatically at the end of each billing period using the payment method on file. You can cancel at any time from Settings → Subscription, from your Apple App Store or Google Play subscription settings (for in-app purchases), or by emailing billing@playsmash.io. Cancellation takes effect at the end of the current paid period — you retain access until then and are not charged again.
9.3 Refunds
Subscriptions purchased through the Apple App Store or Google Play are refundable in accordance with each store's standard refund policy — we honour any refund those stores grant and will remove the corresponding access immediately once refund is confirmed.
For subscriptions purchased directly from us (not through an app store): you may request a refund within 14 days of the initial purchase if you have made no material use of the paid features, and within 30 days of any promotional purchase if the promotion did not deliver the advertised benefit. Refunds are credited to the original payment method. Beyond these windows, renewal charges are non-refundable once the billing period has begun, except where required by UAE consumer-protection law.
9.4 Defective service
If a paid feature does not function as described and we are unable to resolve the defect within a reasonable time, you are entitled — at our choice — to a refund, a replacement period of free access, or a repair of the underlying issue, in line with UAE Federal Law No. 15 of 2020 on Consumer Protection (as amended). Nothing in these Terms reduces or waives the rights UAE law grants you.
10. Limitation of Liability
Smash is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. In particular, Smash is not liable for the conduct of other users outside the Service — including any messages sent via WhatsApp after the Service has generated an invite URL. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.
11. Account Termination
You may delete your account at any time from the Settings page. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be handled according to our Privacy Policy — including the immediate deletion of friendships you participate in.
12. Changes to Terms
We may modify these terms at any time. Material changes — including any change to how social features or contact-sharing work — will be communicated through the app and via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.
13. Governing Law
These terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.
