Open Data Feeds (courts, clubs, rackets, glossary) are licensed under the Creative Commons Attribution 4.0 International License (CC-BY-4.0): https://creativecommons.org/licenses/by/4.0/ You are free to: - Use, copy, and redistribute the data in any medium or format - Adapt, transform, and build upon the data for any purpose, including commercial use Under the following terms: - ATTRIBUTION: You must give appropriate credit in any public-facing use of the data. Required attribution text: Padel data from Smash. (https://playsmash.io) HTML form: Padel data from Smash. - You must include a link to the CC-BY-4.0 license when reasonably practicable. - You must indicate if you made changes to the data. - You may not apply legal terms or technical measures that restrict others from using the data in ways the license permits. These Terms of Use supplement the CC-BY-4.0 license. In the event of conflict between these Terms and CC-BY-4.0, CC-BY-4.0 prevails on the scope of the copyright license. --- 2. ATTRIBUTION REQUIREMENT — DETAIL The attribution requirement applies in any context where the data (or a material portion of it) is displayed to or accessible by end users. This includes: - Websites, apps, or dashboards that display court, club, racket, or glossary data sourced from these feeds - Publications, reports, or articles that cite statistics from these feeds - AI systems, chatbots, or language model contexts that incorporate this data as reference material The attribution may be placed in a footer, credits section, data source label, or any other location reasonably visible to end users. Machine-readable attribution (e.g. in API response metadata or data file headers) satisfies this requirement for developer tools and non-visual applications. --- 3. BRAND USAGE — LIMITATIONS The attribution requirement in Section 1 permits you to use the name "Smash." solely to identify the source of the data. This permission is narrow. It does not grant you: - A license to use the Smash. name, logo, or brand assets for any other purpose - The right to imply that Smash. endorses, sponsors, or is affiliated with your product or service - The right to use "Smash." in your own product name, domain name, or marketing materials If you are unsure whether a proposed use of the Smash. brand is within these limits, contact support@mulham.ai before proceeding. --- 4. ACCEPTABLE USE You may not use the data feeds or the Smash. API for: - Spam, bulk messaging, or unsolicited communications of any kind - Reverse engineering, scraping, or attempting to extract data or functionality from the Smash. application beyond what is published in the open data feeds - Building systems designed to flood or overload the Smash. API - Any unlawful purpose under applicable law, including the laws of the UAE --- 5. RATE LIMITING Smash. reserves the right to rate-limit or suspend access to the data feeds at any time, with or without notice, for any consumer that: - Exceeds reasonable request volumes (indicative threshold: 200 requests per hour) - Violates these Terms - Causes or threatens disruption to the Smash. service Rate limiting does not revoke any CC-BY-4.0 license already granted on data you have previously retrieved. --- 6. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MULHAM ANALYTICS AND AI - FZCO SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH: - YOUR USE OF, OR INABILITY TO USE, THE DATA FEEDS - ANY PRODUCT OR SERVICE YOU BUILD USING THE DATA - ANY INACCURACY IN THE DATA - ANY INTERRUPTION OR TERMINATION OF THE DATA FEEDS THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH THE CLAIM IS BROUGHT AND EVEN IF SMASH. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. --- 8. TERMINATION OF ACCESS Smash. may suspend or permanently discontinue the data feeds at any time, for any reason, without prior notice. Setting the feed status to inactive revokes future access to the API endpoints but does not retroactively revoke any CC-BY-4.0 license already granted on data you have previously retrieved under these Terms. Smash. may terminate your rights under these Terms immediately and without notice if you breach any provision. Upon termination, you must cease use of the data and, where practicable, destroy any copies you hold. The CC-BY-4.0 license termination provisions in Section 6 of that license apply independently of these Terms. --- 9. CHANGES TO THESE TERMS Smash. may update these Terms at any time. The current version will always be available at https://playsmash.io/data-feed-terms.txt. Continued use of the data feeds after an update constitutes acceptance of the revised Terms. Material changes will be noted with an updated effective date at the top of this file. --- 10. GOVERNING LAW These Terms are governed by the laws of the United Arab Emirates and, to the extent applicable, the rules and regulations of the International Free Zone Authority (IFZA), Dubai. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE, unless the parties agree otherwise in writing. --- 11.
